Gather your documents
Collect your sale agreement, payment receipts, builder-buyer agreement, allotment letter, and any correspondence with the builder.
Send a legal notice (optional)
While not mandatory, sending a legal notice to the builder before filing a RERA complaint strengthens your case and shows you attempted resolution.
Identify your state RERA authority
RERA is administered at the state level. Daava automatically identifies the correct authority and portal based on your project's state.
File the complaint
Submit your complaint online at the state RERA portal or in person. Pay the prescribed filing fee (typically ₹1,000 for individuals).
Attend hearings
RERA must dispose of the complaint within 60 days. The authority will hear both parties and pass an order for refund, possession, or compensation.
Frequently asked questions
What complaints can I file under RERA?
You can file for delayed possession, poor construction quality, deviation from sanctioned plan, false advertising, non-registration of the project, failure to provide amenities, and refusal to refund. The project must be registered (or required to be registered) under RERA.
What compensation can I get?
RERA can order the builder to refund your money with interest at SBI PLR + 2% per annum, hand over possession with penalty for delay, pay compensation for mental agony, or rectify defects at their cost.
What is the time limit to file?
There is no specific limitation period under RERA, but complaints should ideally be filed while the project is still registered. For defects in construction, you can complain within 5 years of possession.
Do I need a lawyer?
No, you can file and argue the case yourself before the RERA authority. However, for complex cases involving large amounts, legal representation may be helpful.
